Admissibility Criteria

Before filing your claim, you must make sure that your situation meets the main admissibility criteria:

  • The person involved in the claim must have been, at the time of the incident, a broker or agent which held a permit issued by the Association des courtiers et agents immobiliers du Québec (ACAIQ).
  • The real estate broker or agent must have been exercising his or her profession at the time.
  • You must file your claim within the year following the date upon which you became aware of the facts.
  • You are able to show, with a list of events, people involved and witnesses, and with the relevant supporting documents, that the situation justifies an indemnity, that is, that the real estate broker or agent committed a real estate fraud, a dishonest transaction or a misappropriation of funds.

    ATTENTION: Certain reprehensible acts committed involuntarily by your real estate broker or agent, be it a case of fault, error, negligence or omission, does not fall under the Fonds d’indemnisation du courtage immobilier’s responsibility.
